          This matter concerns an application by the Federated Liquor and Allied Industries Employees' Union of Australia - Tasmanian Branch to amend the Restaurant Keepers Award (the award) in the following manner:

          "Insert the following new subclause in Clause 46 - Part-time Employees:

          (d) Payment for part-time work shall be based on the ordinary hourly rate determined by dividing the appropriate wage rate of the classification in which the employee is working by 38."

          The basis of the application is simply to correct an award drafting deficiency and to now make clear the basis for calculating payment to part-time employees covered in Division D of the award.

          Mr Sherry said that whilst the other Divisions of the award were explicit in this regard the Department of Labour and Industry had indicated that its officers found it difficult to determine pay rates applicable in this particular area.

          Since this is a consent matter and the variation is obvious and self-explanatory I have decided to vary the award in the precise terms of the application.

          Date of Effect

          This variation shall be effective on and from 15 June 1988, consistent with the agreement of the parties.
