T1858

IN THE TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984

T.1858 of 1989

IN THE MATTER OF AN APPLICATION BY THE FEDERATED MISCELLANEOUS WORKERS UNION OF AUSTRALIA TO VARY BOARDING SCHOOLS AND STUDENT HOSTELS AWARD

RE: SUPERANNUATION

COMMISSIONER R.K. GOZZI

HOBART, 10 April 1989

REASONS FOR DECISION

APPEARANCES:

For the Federated Miscellaneous Workers Union of Australia,
Tasmanian Branch

- Mr K. 0'Brien

For the Tasmanian Confederation
of Industries

- Mr M. Sertori

DATE AND PLACE OF HEARING:

6 April 1989   Hobart

In this matter the parties requested the Commission to endorse an appendix to the Boarding Schools and Student Hostels Award to reflect consent arrangements for 3 per cent superannuation contributions to be made by employers.

I now confirm what was indicated on record by me that the variation as sought will be made to the award operative from the beginning of the first pay period to commence on or after 30 March 1989.

In the proceedings there was a deal of discussion between the Commission and the parties going to the question of exemption from the superannuation provisions now formally approved.

As a general comment, I am of the view that those seeking to be exempted should seek to have their case put when the Commission deals with the matter in the first instance.

That is at the time the parties request the provisions for superannuation to be included in the award.

My order in this matter is attached.

R.K. Gozzi
COMMISSIONER
