At the commencement of the hearing, Mr Clues sought and was granted permission to withdraw applications T2437 of 1990 lodged by Mr D Vautin of the SMF Group on behalf of Nelvek Pty Ltd., Ulverstone, and T2443 of 1990 lodged by Glemby International Australia Pty Ltd.

Mr Clues then sought to amend application T2435 of 1990 to enable a new exemption provision to be inserted in the award. The proposed new subclause (f) of Clause 33 is similar to a number of exemption clauses in other awards and it lists the companies which are now exempt from contributing to TASPLAN.

Mr Griffin was prepared to accept the proposed variation and the list of exempt companies.

The proposed variation provides a much more simple and effective mechanism for dealing with exemptions and, in the circumstances, I informed the parties that the award would be varied in the manner sought, with effect from the date of hearing, 18 July 1990.

An order varying the award is attached.
