This was an application by the Federated Miscellaneous Workers Union of Australia, Tasmanian Branch (FMWU) for an occupational superannuation clause to be inserted in the Ice Cream Makers Award (the Award).

Mr K Dando, who appeared for the FMWU, produced an exhibit which detailed the proposed award variation implementing the agreed 3z occupational superannuation provision.

At the request of the Commission some amendments were made to the draft award variation to fit in with "standard" provisions already found in some other Commission awards, but because of the nature of the agreement between the parties in this matter, very little change was required: all parties accepted these amendments.

Mr Dando sought for the operative date to be 1 July 1990.

Mr D Fry who appeared for the Federated Clerks Union of Australia, Tasmanian Branch confirmed his union's agreement to the proposals and also requested that 1 July 1990 be the operative date.

Mr S Clues, who appeared for the Tasmanian Confederation of Industries, confirmed his organisation's agreement to the proposals including the operative date sought.

As indicated at the hearing, I endorse the final agreement between the parties and the Award will be amended accordingly to be operative from 1 July 1990.
