Reasons for Decision in the matter of structural efficiency award variations were issued on 23 August 1990.

However, one particular item, titled "enterprise agreements", was deferred for further hearing when a number of questions were raised in relation to this matter by the Commission.

The questions raised went to both jurisdiction under the Industrial Relations Act 1984, and merit.

Whilst the Federated Liquor and Allied Industries Employees' Union (Tasmanian Branch) (FLAIEU) had included the question of "enterprise agreements" in its application it was indicated to the Commission that this item was included at the request of the Tasmanian Confederation of Industries (TCI) and the FLAIEU did not wish to argue a case in respect of this particular matter.

Subsequent to the Commission issuing written questions which the parties were invited to address in relation to "enterprise agreements" the TCI advised on 29 August 1990 that:

    "At this stage the TCI does not wish to proceed to seek the insertion of an "enterprise agreement" clause into Division A of the Hotels, Resorts, Hospitality and Motels Award. We therefore see no requirement for the hearing scheduled for 30/8/90 to address this issue".

In these circumstances the scheduled hearing was cancelled.

This part heard matter stands adjourned sine die and will be resumed upon notification by either party that they are in a position to answer the questions raised by the Commission.
