This matter concerns an application by the Tasmanian Public Service Association (TPSA) to vary the General Conditions of Service Award by varying Clause 8, "Allowances", subclause P, "Travelling" paragraph 2, "Kilometreage Allowance".

The application seeks to adjust kilometreage allowances in line with a formula established by a Full Bench decision1 of this Commission.

There has been a pattern of similar adjustment occurring from time to time and since this is a consent matter and neither the requirements of the Wage Principles nor Section 26 would be offended by granting the application I have decided to vary the amount in the manner sought.

Operative Date

The Tasmanian Public Service Association sought a retrospective date of effect to 3 August 1990 when the application was lodged.

This was opposed by the Minister, and since there were no demonstrated special circumstances consistent with the requirements of Section 37(5)(b) of the Act the variations concerned shall be operable from the first full pay period to commence on or after 21 August 1990.
