Wage Rates - State Wage November 1989 - Structural Efficiency Principle - Second Stage Interim - Special Case

REASONS FOR INTERIM DECISION

In this matter the Tasmanian Salaried Medical Practitioners Society (Society) sought a variation to the Medical Practitioners (Public Sector Award to give effect to the second instalment structural efficiency adjustment on an interim basis pending the outcome of special case proceedings consequential to the "arguable case" finding of the President in Anomalies Conference TA66 of 1990.

The parties presented an agreed position in respect to Exhibit M1 Structural Efficiency Adjustment - Medical Practitioners Tasmanian Public Sector and Exhibit M21 - Award Restructuring Development and Implementation Proposal - Medical Practitioners.

Mr House for the Tasmanian Salaried Medical Practitioners' Society presented the Commission with a list of matters where agreement existed between the parties. These matters, which will eventually appear in the Award, can be summarised as follows:

1. The need to develop a new comprehensive and up-to-date award.

2. The need to develop an improved career structure.

3. The need to adopt new designations/classifications:

· Career Medical Officer/Hospital Medical Officer (to replace Medical Practitioner classification).

· Senior Registrar

· Consultant, Senior Consultant and Director (to replace Specialist classifications).

4. The need for new classification/work level standards.

5. New salary scales to be dealt with by the Commission as a Special Case effective no earlier than 1 January 1991.

6. Award definitions to be revised including those relating to qualifications.

7. The introduction of permanent part time work provisions.

8. Portability of sick leave entitlements for Resident Medical Officers transferring to other locations within the Agency or State Service.

9. Adoption of anniversary date for recreation leave accrual purposes.

10. Rewording of Duty Roster clause.

Mr House also pointed out that a number of issues still had to be finalised and they include:

1. Salary structure (including absorption of some allowances)

2. Penalty rate structure and other allowances (form as well as quantum).

3. Adoption of standard working hours.

4. Contractual arrangements for junior and senior staff.

5. Conjoint (hospital-university) appointments.

6. Sick leave arrangements (including those relating to nosocomial infection).

7. Conditions pertaining to conference, study and sabbatical leave.

8. Deleting provisions in Clause 20 of the current award.

9. The introduction of shift work provisions (on a selective basis).

10. Award provisions for permanent part time work.

The parties indicated that a number of these issues would be further debated at a meeting planned for 23 October 1990 and they would be prepared to report back to the Commission in December at which time they may be in a position to include in the Award matters that had been finalised.

In view of the advanced negotiations already undertaken by the parties going to the restructuring of this Award I am prepared to grant an interim increase in line with the State Wage Case Decision i.e.

1. For salaries below $21897 - the increase shall be $650pa.

2. For salaries of $21897 to $26780 - the increase shall be $780pa.

3. Where salaries are above $26780 - the increase shall be 3%.

I also endorse as part of this package the understandings as expressed in Exhibits M1 and 2 and H1 and agreed to by the parties.

These matters taken as a whole warrant increasing the salary rates appearing in the Award by the amounts previously mentioned.

I would expect and encourage the parties to continue with their deliberations thus enabling a comprehensive report to be presented to the Commission when it next reconvenes on this matter at 10.30am on Tuesday 18 December 1990.

The operative date of these variations shall be from the first full pay period to commence on or after 12 September 1990 being the date agreed to by the parties.

The Order giving effect to this decision is attached.
