RE: CLERICAL AND ADMINISTRATIVE EMPLOYEES (PRIVATE SECTOR) AWARD

In this matter the Federated Clerks' Union of Australia, Tasmanian Branch (FCU), sought the making of an award to cover clerical and administrative employees in the private sector. Details of the FCU's original application of 21 August 1990, as subsequently varied at the commencement of the hearing, are as follows:

    "TITLE

    This award shall be known as the Clerical and Administrative Employees (Private Sector) Award.

    SCOPE

    This award is established in respect of Private Sector clerical and/or administrative employees which shall include persons engaged in a clerical and/or administrative capacity and, without limiting the generality of the foregoing, all persons engaged in the occupation of shorthand writers and typists and/or on any machine designed to perform or assist in the performance of clerical or administrative functions.

    This award shall not apply to State employees or employees covered by any other award of the Tasmanian Industrial Commission."

The FCU requested the Commission to determine the matters of title and scope for the new award in accordance with its application. Mr. Fry, for the FCU, indicated that the intention was to take from the Retail Trades Award its general application to clerical employees and provide for them under the new award.

He believed the application met all the tests of the current wage fixing principles and did not offend the public interest. He noted that there had been no opposition to the application.

Mr. Abey confirmed the fact that discussions had taken place with the FCU and that he was in a position to consent to the application.

Having regard to the consent between the parties and the understanding that the new award, at least initially, will mirror the rates of pay and conditions for clerical employees contained in the Retail Trades Award I endorse, with minor amendment, the proposed new title and scope.

The order giving effect to this decision is attached. The operative date is 5 September 1990.

Following the expiry of the statutory appeal period, provided the matter is not appealed, registered organisations may seek an interest in the new award in accordance with the provisions of Section 65A of the Act.

When those matters are concluded the process of determining the content of the award will commence.
