POLICE AWARD

Expense-related allowances

REASONS FOR DECISION

This application sought to vary certain provisions in the Police Award which contain expense-related allowances.

The increase sought was 8.56%, being the movement in the Consumer Price Index for the twelve months ended 31 March 1990.

Mr. Kadziolka submitted that the method of adjusting expense-related allowances conformed with previous decisions of the Commission, in particular T.833 of 1987 and, more recently, in Matters T.2638 and T.2651 of 1990 dealing with a number of public sector awards when the identical process was confirmed by a Full Bench.

It was submitted that the public interest would not be offended by approving such an increase in this award.

Mr. Kadziolka requested an operative date of 10 September 1990, or failing that, the date of hearing. Acting Inspector Grant confirmed the consent of the Commissioner of Police to the proposed rates, which had been checked. However, the Association's claim for retrospectivity was opposed. The Commissioner of Police submitted that there were no special circumstances which warranted a retrospective date of operation and that the normal practice of applying the date of the decision as the operative date was also appropriate on this occasion.

As indicated the application is in accordance with the wage fixing principles, and the previous practice of this Commission, and the award will be varied in the manner sought, effective from 17 October 1990. The necessary order is attached.
