Labour on-costs - 3% occupational superannuation

REASONS FOR DECISION

This was an application by The Australian Workers' Union, Tasmanian Branch (the Union), made under Section 23 of the Act, for an amendment to the Quarrymens Award (the Award) to provide for occupational superannuation.

At the hearing, Mr V Jacobs, who appeared for the Union sought the granting of the application and produced an exhibit being a draft amendment clause.

Mr Jacobs spoke to the exhibit which, he said, reflected very much the type of occupational superannuation provisions developed within this Commission in recent times. He pointed out that the one approved fund was TASPLAN which is specified in a number of this Commission's awards and there were exemption provisions in the proposed amendment.

Mr Jacobs further advised that agreement had been reached with the employer representatives as to the application and he sought for the operative date to be the date of the hearing, the 22nd of November 1990.. He said that, to his knowledge, all employees in the industry by agreement were already in receipt of the superannuation benefits sought.

Mr J Long who appeared for the Australasian Society of Engineers, Tasmanian Branch, agreed with the Union's submissions and supported them.

Mr S Clues, who appeared for the Tasmanian Confederation of Industries (the Confederation), confirmed agreement to the proposed amendment to the Award and to the operative date sought. He said that the agreed matters had resulted from discussions between the parties.

As indicated at the hearing, I endorse the agreement between the parties for the implementation of an occupational superannuation provision in the Award. I find that the terminology and content of the proposed amendment does fit the Superannuation Principle and all the requirements therein have been met.

The amendment will operate from 22 November 1990.
