TP1/2

IN THE MATTER OF A REFERRAL PURSUANT TO SECTION 63(10(b) FOR DETERMINATION OF INTEREST OF THE FEDERATED ENGINE DRIVERS' AND FIREMEN'S ASSOCIATION OF AUSTRALASIA, TASMANIAN BRANCH IN THE GENERAL CONDITIONS OF SERVICE AWARD and Correction Order

COMMISSIONER P A IMLACH

HOBART, 13 March 1990

REASONS FOR DECISION

APPEARANCES:

For the Tasmanian Public Service Association

- Mr G Vines

DATE AND PLACE OF HEARING:

9 March 1990 Hobart

This is an award interest determination referred to me by the President under Section 63(10) of the Act.

The Federated Engine Drivers' and Firemen's Association of Australasia, Tasmanian Branch (the FEDFA) sought an interest in the General Conditions of Service Award and the Tasmanian Public Service Association (the Association) objected to the granting of that interest.

At the hearing Mr G Vines appeared for the Association.

The FEDFA-was not represented.

Mr G Vines, for the Association, advised that as the FEDFA is a party to the Award and has already held an interest in it for some time, he would adhere to his "status quo" argument and therefore sought to withdraw the Association's objection. He read into transcript a letter from the Association to the FEDFA confirming the withdrawal and the circumstances surrounding it.

The application for withdrawal was granted and the FEDFA's interest in the General Conditions of Service Award is confirmed.
