Superannuation Clause - qualifying period

REASONS FOR DECISION

The substance of the Clerical and Administrative Employees (Private Sector) Award which was determined with effect from 1 January 1991, was based on existing conditions contained in the Retail Trades Award. The parties were required to submit a consent document reflecting those provisions. The intention was to mirror in total those provisions in the new award.

Mr. Abey, for the Tasmanian Confederation of Industries, submitted that in the translation process an error had occurred in the draft document which set the qualifying period for superannuation at one month rather than 6 months as in the Retail Trades Award. As a consequence this application sought to rectify the position.

Both the Federated Clerks Union and the TFGA Industrial Association agreed that the draft document was incorrect and concurred that Clause 29 of the award should be varied by inserting 6 months in lieu of one month, the amendment to have retrospective effect to 1 January 1991.

In the circumstances the award will be varied as requested effective from 1 January 1991. The appropriate order is attached.
