Expense related allowances This application, lodged on 17 October 1991, sought to adjust expense related allowances in the award to take account of consumer price index movements for the twelve months ended 31 March 1991. Allowances in this award which fall into the category of "expense related" are:-
Mr. Kadziolka explained that in accordance with the usual practice for adjusting expense related allowances, the weighted average of the Eight Capital Cities CPI was used. For the period in question the percentage change was 4.89%. It was submitted that the adjustment was in accordance with the Wage Fixing Principles and followed a recent decision of this Commission in relation to other public sector awards containing expense related allowance provisions. Mr. Kadziolka requested a retrospective date of operation of 17 October 1991. Senior Sergeant Grant, for the Commissioner of Police, consented to the general terms of the application but was not prepared to concede any retrospectivity. He submitted instead that the date of operation should be the date of the Commission's decision. Intervening on behalf of the Minister Administering the Tasmanian State Service Act, Mr. Willingham indicated that the Minister was not opposed to the generality of the claim. However, since this application was the last public sector award to be varied for this purpose, he wished to inform the Commission and to place on record for the benefit of the parties, the intention of the Minister to pursue a different method of adjusting such allowances for the future. The Eight Capital Cities Index was a general one, Mr. Willingham said, and it might prove more appropriate if, for example, specific indices in relevant statistical groups or subgroups were to be used. This consent application is approved; however, as I indicated on transcript, I could not accept that there were special circumstances in this case to persuade me to grant the Association's request for a retrospective date of operation. Accordingly the award will be varied with effect from 28 October 1991. The necessary order is attached.
