Wage rates - State Wage August 1991 - minimum rates adjustment classification structure

REASONS FOR DECISION

This was an application by the Federated Clerks Union of Australia, Tasmanian Branch (the Union) for an amendment to be made to the Insurance Award (the Award) to introduce a new classification structure and a related wages scale together with the commencement of the Minimum Rates Adjustment (MRA) process in accordance with the Wage Guidelines.

The Tasmanian Confederation of Industries (the Confederation) made submissions in support of the application on behalf of all parties. Two exhibits were produced, one giving full details of the proposed classification structure, the other detailing the proposed new 5 grades wages scale and the phased introduction of the MRA's.

The Confederation advised that two streams of employees were to be incorporated in the new structure; one for clerical/administrative officers, the other for assessors. The assessors were to come into the scale at Grade 2 level and progress on promotion. It was proposed (although not clearly specified so in the explanations for Grades 1 and 2) that clerical/administrative officers would commence at the Grade 1 level and subject only to a review at the end of the first twelve months (considered to be a training period) would automatically progress to Grade 2: from then on progress would be by promotion.

The relativity of each Grade to the 100% tradesman's rate, as currently prescribed ($417.20 per week) was also shown in one of the exhibits. The range for the five grades was between 86% and 108%.

The Confederation also advised that the changes proposed were foreshadowed at the time of the implementation of the second Structural Efficiency Principle increase in the Award and reflected the result since then of negotiations and a trial which had resulted in some improvements or additions being made to the proposals.

It was also confirmed that the structure proposed was unique to the Award and fitted to the industry involved.

The Confederation finally submitted that the amendments sought were in accordance with the current Wage Principles and not against the public interest.

The Union confirmed its agreement to the proposals subject only to its (oft repeated) qualification that it would be seeking at some time in the future to align all clerical rates and scales to the comparatively recently established Administrative and Clerical Employees Award.

The parties agreed that the operative date would be the first full pay period to commence on or after 4 December 1991.

The proposals contained in this application were all in accordance with the requirements of the current Wage Guidelines and I am satisfied it is in the public interest that they be endorsed.

The Award will be amended as sought operative from the agreed date, the first full pay period commencing on or after 4 December 1991.
