TASMANIAN INDUSTRIAL COMMISSION Industrial Relations Act 1984 Federated Clerks Union of Australia, QUARRYMENS AWARD
Award interest REASONS FOR DECISION This was an application made under Section 65A of the Act by the Federated Clerks Union of Australia, Tasmanian Branch (the Union) for reference to it to be deleted from the Parties and Persons Bound clause of the Quarrymens Award (the Award). At the hearing the Union advised that it sought the deletion on the grounds that it no longer had an interest in the Award. Previously the Union had reached agreement with the Tasmanian Confederation of Industries (the Confederation) during Structural Efficiency Principle negotiations and all clerical classifications had been removed from the Award during that exercise.1 As a consequence to this application the Union also sought for its Certificate of Registration to be recalled and for reference in it to the Quarrymens Award to be deleted. The Confederation confirmed its agreement to the application and, in doing so, advised that: by agreement, some residual clerical duties (which were minimal) would be covered by the weighbridge operator classification; and any clerks employed by quarry operators then or in the future would be covered by the Clerical and Administrative Award. I have heard the parties in this matter and I am satisfied that the Union no longer has an interest in the Award and I therefore determine, under subsection (3) of Section 65A of the Act, that the FCU no longer has an interest in the Quarrymens Award. The award will be amended by the deletion of the reference to the Union in the Parties and Persons Bound clause. A copy of this determination will be forwarded to the Registrar in accordance with the requirements of subsection (6) of Section 65A of the Act. An order is attached.
