Determination of award interest

REASONS FOR DECISION

Following the making of the Community Services Award operative from 22 January 1992, the Australian Social Welfare Union, Tasmanian Branch, (ASWU) initiated processes in accordance with Section 65A of the Industrial Relations Act 1984 (the Act) for it to have an interest determined in the award. Pursuant to Section 65A(2) of the Act the matter was referred to me for determination.

In matters of this kind I am required to satisfy myself that the ASWU can meet the requirements of Section 63(10)(c)(i), (ii) and (iii) of the Act. In that regard Mr Patterson for the ASWU demonstrated that the ASWU has members in the industry subject to Clause 2 - Scope of the Community Services Award, that the registered rules of the ASWU enable coverage of employees who are employed in or in connection with the industry of social and/or welfare work, and that the orderly conduct of industrial relations in Tasmania would not be prejudiced if the ASWU was granted an interest in the award.

Mr Fitzgerald appearing for the Tasmanian Confederation of Industries (TCI) supported the submissions of Mr Patterson with regard to the orderly conduct of industrial relations in Tasmania and generally supported the determination of interest in the award for the ASWU.

The Community Services Award making process has been protracted and there is still a way to go to finalise wage rates and conditions. Whilst the completion of those matters may take some time yet, progress in that regard will be facilitated as a consequence of the decision of the Commission in this matter to grant an interest to the ASWU in the award.

Date of Effect:

The order, operative from 12 March 1992, is attached. A copy of this determination has also been forwarded to the Registrar pursuant to Section 65A(6) of the Act.
