TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984
s.23 application for award or award variation

Metals and Engineering Workers' Union
(T.3736 of 1992)

METAL AND ENGINEERING INDUSTRY AWARD

COMMISSIONER R J WATLING

21 May 1992

Award variation - inclusion of sheetmetal working in Clause 2 - Scope

REASONS FOR DECISION

This application was lodged by the Metals and Engineering Workers' Union for the purpose of varying the scope of the Metal and Engineering Industry Award to include sheetmetal working.

Prior to a decision of the Commission arising out of application T.3609 of 1991, sheetmetal working fell within the scope of the Plumbers Award.

That decision clarified the scope and definitions of the Plumbers Award to put it beyond doubt that sheetmetal work within that award is only in respect to plumbing work (as defined).

With the establishment of the Metal and Engineering Industry Award the parties expressed a desire to have sheetmetal working in general bought under the scope of that award.

In view of the earlier mentioned decision1 and because it is eminently sensible to do so, I hereby determine that the scope clause contained in the Metal and Engineering Industry Award be varied to include sheetmetal working in general.

The order giving effect to this decision will be included in the order arising out of application T.2757 of 1990 and from the same operative date as that matter i.e. the first full pay period on or after 1 June 1992.
