Deletion of references to Receptionist/Clerk classification - Variation to Parties and Persons Bound clause - Determination of award interest

REASONS FOR DECISION

In these matters the Federated Clerks Union of Australia, Tasmanian Branch (FCU) sought to:

(1) delete from the Hairdressers Award all reference to Clerks, including the removal of the union from Clause 6, Parties and Persons Bound (Application T3794); and

(2) have its interest in the Hairdressers Award removed (Application T3796).

Mrs Dowd, for the FCU, requested that the two matters be joined for the purposes of the hearing. There being no objection, that request was granted.

Mrs Dowd informed the Commission there were "only one or two" hairdressing establishments in the State which employed full-time receptionist/clerical staff. In the main, clerical work was performed by the owners or managers of their businesses. Reception work was carried out by hairdressing employees as a relatively minor, although important, part of their duties. It was submitted that in those establishments where there were full-time reception/clerical staff the Clerical and Administrative Employees (Private Sector) Award would have application. There was no need therefore for the FCU to retain an involvement in the Hairdressers Award. Accordingly, Mrs Dowd requested that the Commission formally determine that the union no longer has an interest in the award and refer that finding to the Registrar to be processed in accordance with Section 65A of the Act.

For the Tasmanian Confederation of Industries, Mr Abey consented to both applications.

In the circumstances the application to vary the award to remove the FCU from the Parties and Persons Bound clause, and to delete reference to Receptionist/Clerk is approved with effect from 20 May 1992. An order to that effect is attached.

With respect to the second matter, and having regard to the requirement in Section 65A(5) that "a Commissioner shall take into account such matters specified in Section 63(10(c) as are relevant", I determine that the FCU no longer has an interest in the Hairdressers Award. This determination will be forwarded to the Registrar to be processed in accordance with Section 65A of the Act.
