TASMANIAN INDUSTRIAL COMMISSION Industrial Relations Act 1984 Tasmanian Confederation of Industries PROFESSIONAL ENGINEERS (PRIVATE INDUSTRY) AWARD
Scope REASONS FOR DECISION This matter concerns an application by the Tasmanian Confederation of Industries (TCI) to vary the Professional Engineers (Private Industry) Award by changing the "scope" clause. Currently the award provides in Clause 2 - Scope that: "This award applies to the whole of Tasmania to any person or persons, or class of persons employed in performing engineering duties as hereinafter defined but not including: Professional Engineers employed in Federal OR State Government departments or instrumentalities, or Local Government authorities; or the MARINE Board of Hobart, the Port of Launceston Authority, Port of Devonport Authority, the Burnie Port Authority." The proposal is to delete existing Clause 2 and insert the following: "2. SCOPE The award applies to the who le of Tasmania to any person or persons, or class of persons employed in performing engineering duties as hereinafter defined but not including: Professiona1 Engineers employed in Federal or State Government departments or instrumentalities, or Local Government authorities; or the Marine Board of Hobart, the Port of Launceston Authority, Port of Devonport Authority, Burnie Port Authority or professional engineers falling within the scope of the Metal and Engineering Industry Award." The variation is one of consent, and arises through the creation of the new Metal and Engineering Industry Award of this Commission. It is logical to avoid overlap of coverage; and because the variation is merely consequential it is hereby granted. Date of Operation This variation to the award shall come into operation on the first full pay period to commence on or after 19 August 1992. Order is attached.
