Minimum rates adjustment

REASONS FOR DECISION

This matter concerns an application by The Australian Workers' Union (AWU) to vary the Dairy Processing Award by awarding the second structural efficiency increase in a manner consistent with the Full Bench decision in the matter of the State Wage Case as it relates to the Minimum Rates Principle.

The matter is one of consent and the details of the adjustment- are contained in a common exhibit.

The parties have acknowledged on record that, to the extent necessary, absorption of over award payments may occur.

Since there is agreement, and the application conforms with Wage Fixation Principles, I am satisfied that it would be consistent with public interest requirements to grant the increase.

Accordingly it is my decision that this award be varied by applying the second minimum rates adjustment based upon the agreed figures and relativities. When the final adjustment is made, minimum rates must be separately expressed in the award.

Date of Operation

This variation shall come into operation from the first full pay period to commence on or after 29 June 1992.
