TASMANIAN INDUSTRIAL COMMISSION Industrial Relations Act 1984 Transport Workers' Union of Australia, CARRIERS AWARD
Award variation - (a) corrections to errors in award (b) payment of wages 3% occupational superannuation REASONS FOR DECISION This was an application by the Transport Workers' Union of Australia, Tasmanian Branch (the Union) for a number of amendments to be made to the Carriers Award (the Award). Except for one item the amendments sought were merely corrections to anomalies in the Award which would not add in any way to the provisions of the Award nor change their effect. The only other item sought was the inclusion in the Payment of Wages clause of the Award of an additional subclause stating: "The deta i 7s provided by the emp 7oyer sha 7 7 a 7so include the amount of any superannuation contribution made by the employer in accordance with subc7ause 39(c) herein and the name of the Fund to which any contribution is made." The merits of this last proposed amendment have already been considered and decided upon favourably by the Commission in matter T3843 of 1992. For the reasons given in the decision pertaining to that matter I endorse this part of the application. The Tasmanian Confederation of Industries confirmed its agreement to all the amendments sought and acknowledged that they were aimed simply at correcting anomalies only or adding the additional subclause previously referred to. On the basis that I am satisfied that the anomalies sought to be corrected by the application are just such, I endorse the corrections sought. I am satisfied that all the amendments sought in this application are not against the Guidelines of the Commission nor the public interest as set out in Section 36 of the Act. The Award will be amended as sought operative from the first full pay period commencing on or after 23 June 1992. An order is attached.
