Award variation - union structure - change of name REASONS FOR DECISION All these matters were joined at the outset. The applications were made by the Australian Liquor, Hospitality and Miscellaneous Workers Union, Tasmanian Branch (the Union) and sought simply for the name "Federated Miscellaneous Workers Union of Australia" (the FMWU), wherever appearing in all the awards subject of the applications, to be changed to the name of the Union. The applications follow the formal amalgamation of the Federated Liquor and Allied Industries Employees' Union of Australia and the FMWU which was completed on 3 August 1992 in the Australian Industrial Relations Commission. The amalgamation was later confirmed in the jurisdiction of this Commission effective from 3 August 1992. In that confirmation before this Commission the name of the FMWU was changed to that of the Union; consequently these applications for a name change have been made in respect of those awards in which the name of the FMWU is found currently. The Union noted that the FMWU was granted interest in the Restaurant Keepers Award on 31 July 1992 and hence the application for a name change in that award was in order. The Union also sought for the name changes to be made operative from 3 August 1992 in order to be consistent with all the other changes associated with the amalgamation of the two unions. No other party appeared at the hearing. I am satisfied that these applications are in order and the amalgamation has been properly completed and there being no objections, the award will be amended by the deletion of all references to the FMWU appearing in the Awards the subjects of these applications and replacing them with the name of the Union. The amendments will operate from 3 August 1992. Orders will be issued in due course.
