Award variation - Retail Trades Award - relativity and loaded hourly rate in respect of Classification 3A

REASONS FOR DECISION

These applications which had identical implications, were joined at the outset of proceedings. Mrs Dowd, for the Federated Clerks Union, explained that as part of the introduction of the new classification structure into the award as from 1 July 1992, it had been agreed that the relativity for the classification of Retail Employee Grade 3A, covering position of Clerical Officer and Corsetiere, would be achieved over the period 1 July 1992 to 1 June 1994. This adjustment, to be effective from the agreed date of 1 December 1992, established the relativity, temporarily, at 93.5%. Consequential adjustments were necessary to the rates applying to the same classification in Clause 20, Loaded Hourly Rate. Mrs Dowd submitted that the application did not offend the wage fixing principles, nor were they contrary to the public interest.

Mr Griffin, for the Shop Distributive and Allied Employees Association, endorsed the submissions of Mrs Dowd.

On behalf of the Tasmanian Confederation of Industries and the Retail Traders' Association, Mr Clues advised the Commission that, following discussions with the two unions, the employers had reached a position where consent could be indicated and, because of the original understandings, the retrospective date of operation could be agreed.

As submitted by Mrs Dowd and Mr Griffin, the phasing in of the new relativity for the classification concerned was agreed as part of the introduction of the integrated classification structure, and endorsed by the Commission on that basis. The new structure was developed as part of the structural efficiency exercise, and the proposed new rates have been known for some time.

In the circumstances the applications, which seek to insert those agreed provisions into the award, are approved with effect from the first full pay period to commence on or after 1 December 1992.
