s.23 application for award or award variation

(T.4180 of 1992)

FISH AQUACULTURE AND MARINE PRODUCTS AWARD

COMMISSIONER R J WATLING

3 February 1993

Wage rates - inclusion of a rate for trainees - consent matter - award varied - ffpp 22 February 1993

REASONS FOR DECISION

When the rates of pay and conditions of employment were finalised for the Fish, Aquaculture and Marine Products Award on 29 November, 19911, it contained a provision for trainees and specifically a Trainee Seafood Handler.

In presenting the draft order to the Commission, the parties omitted to provide a rate of pay for the trainee classification.

This application seeks to redress that omission.

The parties presented an agreed position to the Commission which clearly identified the rate of pay applicable to Trainee Seafood Handlers.

As the application is consistent with the Wage Fixing Principles and the Public Interest requirements of the Act and as it technically formed part of the original applications2 I am prepared to endorse this consent matter.

In keeping with the wishes of the parties, the award will be varied from the first full pay period on or after 22 February 1993. The Order giving effect to this decision is attached.
