Registration as an organisation of employees

REASONS FOR DECISION

This application for registration was lodged by The Australian Institute of Marine and Power Engineers - Victorian Branch on 30 September 1991.

Following the serving of statutory notices pursuant to Section 63 (2)(a) of the Act, notices of objection to the registration of the abovenamed were lodged by:

1. The Federated Miscellaneous Workers Union of Australia.

2. The Tasmanian Public Service Association.

3. The Association of Professional Engineers and Scientists, Australia, Professional
    Engineers Branch, Tasmania.

In accordance with the requirements of the Act a hearing was convened for the purpose of determining the application and the objections, thereto.

At an initial hearing on 13 December 1991 The Tasmanian Public Service Association withdrew its objection on the basis of an undertaking given by the applicant in relation to hospital engineers. The hearing was then adjourned to enable further discussions to take place between the applicant and the remaining objectors.

At a further hearing on 16 June 1992 following the tendering of a document (M1) providing for a joint agreement between The Association of Professional Engineers and Scientists, Australia, and the applicant and an undertaking given by the applicant to The Federated Miscellaneous Workers Union, Tasmanian Branch, the remaining objections were withdrawn.

I am satisfied that the application for registration by The Australian Institute of Marine and Power Engineers complies with the requirements for registration specified in the Act and the application is now granted. A certificate of registration will be issued pursuant to Section 64(1) following the determination by a Commissioner of award interest.
