Award variation - Structural Efficiency Principle - Special Case Principle - further award variation to wage rates and associated matters

REASONS FOR DECISION [Previous Decision]

This file has been kept open to allow the phased implementation of structural efficiency changes in schools and colleges subject to the Catholic Education Award.

Limited wage increases have been granted since the finding of an "arguable special case" in matter T.A. 73 of 1991, together with concomitant conditions of employment matters.

Reasons for Decision issued on 13 August 1991 and again on 10 September 1992 dealt with the progressive phasing-in of changes as they occurred.

This matter therefore represents the next stage of this continuing process, and relies upon the same reasons previously issued.

At Hobart on 21 December 1992 the parties advised the Commission that further consultation had taken place and that such negotiations had been both amicable and constructive and resulted in consent for a further modest wage increase and some modifications to certain conditions of employment. Apart from anything else the parties had closely monitored the public sector "teachers case decision (T No 2887 of 1991 and others) handed down on 30 November 1992 and had regard for its outcome.

The present proposal was to advance the wage rate for teachers on Band 1 structure, level 13, from $36,177 per annum to $37,048 per annum, an increase of 2.41%. Increases to other Band structure teachers varies from .44% to 2.65%.

Similarly since salary levels for Deputy Principals in secondary schools are on a set percentage of the level 13 rate, Class 1 Deputy Principals are to advance from $45,221 per annum to $46,310 per annum and Class 2 Deputy Principals will advance from $46,307 per annum to $47,421 per annum.

The award is now to also contain provisions concerning:

(a) Duties and responsibilities.

(b) Release time.

(c) Other conditions relating to appointees who do not meet qualifications required.

Proportionate wage increases are proposed for Teachers Band 3, together with new provisions relating to the advertisement of acting Band 3 positions. In addition like adjustments of salaries are to flow-on to the classifications of Subject or Year Co-ordinator; Teacher Administrator; and Religious Education Co-ordinators.

Since this matter is one of consent and the Commission has vigorously tested outcomes against the requirements of both the work value principle and the structural efficiency principle I am satisfied on the evidence before me that to accede to the request of the parties to rectify the proposals would meet the requirement of the Principles as a whole.

I am also satisfied that the phased changes to the award would have minimal impact and be consistent with public interest.

Accordingly the application is granted and the award will be varied.

Date of Operation

These variations to the award will come into operation as from the first full pay period to commence on or after 1 January 1993.
