Determination of award interest by CFMEU

REASONS FOR DECISION

This was an application by the Registrar to the President pursuant to Section 65A(1) of the Industrial Relations Act 1984 (the Act) for the recall of the Certificate of Registration of the Construction Forestry Mining and Energy Union, Tasmania Branch (CFMEU) so that it could be amended to include the Laundry and Dry Cleaning Award. The application was referred to me for determination.

The circumstances were that The Federated Engine Drivers' and Firemen's Association of Australia, The Operative Plasterers and Plaster Workers' Federation of Australia and the Construction Forestry Mining Employees Union amalgamated to form the Construction Forestry Mining and Energy Union. This amalgamation was approved in the Australian Industrial Relations Commission effective from 23 September 1992 and by the Tasmanian Industrial Commission on 18 December 1992.

Accordingly, and having regard to the requirements of Section 63(10)(c)(i)(ii) and (iii) of the Act, I concluded that the CFMEU has an interest in the Award. A copy of this determination of interest was forwarded to the Registrar as required by Section 65A(6) of the Act.
