(T.4192 of 1992)

EMU BAY RAILWAY AWARD

COMMISSIONER R K GOZZI

HOBART 10 February 1993

Insertion of CFMEU into Clause 6 - Parties and Persons Bound

REASONS FOR DECISION

This application by the Construction Forestry Mining and Energy Union, Tasmanian Branch (CFMEU) sought the variation of the Emu Bay Railway Award to reflect in that award the outcome of determination of interest proceedings in matter T.4169 of 1992.

In those particular proceedings effect was given to the amalgamation of the Construction Forestry Mining Employees Union, the Federated Engine Drivers' and Firemen's Association of Australasia and The Operative Plasters and Plaster Workers' Federation of Australia which occurred in the Australian Industrial Relations Commission in September 1992. Effect was given to the amalgamation of the corresponding organisations in this State in December 1992.

Having regard to the foregoing, the Construction Forestry Mining and Energy Union, Tasmanian Branch, will be included in the Parties and Persons Bound clause of the Emu Bay Railway Award. Accordingly reference to the Federated Engine Drivers' and Firemen's Association of Australasia, Tasmanian Branch will be deleted.

The order, operative from the date of this decision is attached.
