Award variation - deletion of clause 8(c) - Trainees and insertion of new clause for Junior Employees

REASONS FOR DECISION

In this matter the Automotive Metals and Engineering Union, (AMEU) made application to vary the Draughting and Technical Officers (Private Industry) Award. The variations requested to be made related to Clause 8 - Wage Rates.

Mr Barker appearing for the AMEU informed the Commission that Clause 8(a) should be replaced in its entirety as an error had been made at the time of adjusting the award for the third minimum rates adjustment and for the 2.5 per cent State Wage Case increase. The effect of the error was to distort the 100 per cent of the tradespersons' rate and in consequence all other relativities derived from that rate.

Mr Baker also requested the inclusion of a new subclause in Clause 8 relating to a classification level for those employees without prior work experience but who are qualified. Mr Baker submitted that the appropriate classification should be the proposed level 9(b) Draughting/Engineering Associate Level II - Without Experience.

A further variation requested to be made related to subclause 8(c)(III) to reflect that "Trainees" rates of pay will be linked on a percentage basis to the rate of pay for Level 2 Draughting/Technical Assistant Level II - which is the 100 per cent rate in the award.

The variations requested to be made were supported by Mr Clues appearing for the Tasmanian Confederation of Industries. Mr Clues also referred to the extensive discussions between the parties to reconcile the error which had occurred in the award with regard to wage rates in clause 8(a).

Both Mr Baker and Mr Clues requested that the variations to the award operate from the first full pay period to commence on or after today's date.

The variations and the operative date are endorsed. The order is attached.
