s23 application for an award or variation of an award

The Association of Professional Engineers and Scientists, Australia
Professional Engineers' Branch, Tasmania

(T.4300 of 1993)

PROFESSIONAL ENGINEERS (PRIVATE INDUSTRY) AWARD

PRESIDENT F D WESTWOOD

8 APRIL 1993

Wage Rates - minimum rates adjustment - Structural Efficiency Principle

REASONS FOR DECISION

The Association of Professional Engineers and Scientists, Australia, Professional Engineers Branch, Tasmania, by application dated 19 March 1993, sought to vary the Professional Engineers (Private Industry) Award by applying the fourth minimum rates adjustment in accordance with the State Wage Fixing Principles.

The parties had agreed to phase in four adjustments, to be fully absorbable against over-award payments. The present application represents the fourth and final step in the series of ongoing adjustments.

The variation was not opposed by the Tasmanian Confederation of Industries. It was submitted that it would not offend secton 36 of the Industrial Relations Act 1984 relating to public interest considerations, and the proposed operative date was agreed by both parties to the award.

In all of the circumstances the application is approved and the award will be varied accordingly with effect from the first full pay period commencing on or after 8 April 1993.

The order is attached.
