TASMANIAN INDUSTRIAL COMMISSION Industrial Relations Act 1984 Australian Workers' Union, PLANT NURSERIES AWARD
Wage rates - State Wage November 1989 - Third minimum rates adjustment - Principles satisfied - consent matter - application granted - award varied - ffpp 30 July 1993 Award variation - reduce ordinary hours of work from 39 hours per week to 38 hours per week - second part of phased in 38 hour week - consent matter - award varied - ffpp 1 June 1993 REASONS FOR DECISION Applications T.4377 and T.4378 of 1993 were made by the Australian Workers Union, Tasmania Branch for the purpose of varying the Plant Nurseries Award to reflect the third minimum rates adjustment and a reduction in ordinary hours from thirty nine (39) to thirty eight (38) respectively. In a decision of 30 June, 1992, (T.3111 of 1991) the Commission acknowledged the agreement of the parties to phase in the 38 hour week for this award along with minimum rates adjustments. This formed part of the restructuring agenda for the Plant Nurseries Award. These applications come before the Commission as consent matters and they conform with the Wage Fixing Principles and the Public Interest requirements of the Act. That being the case the award will be varied in the manner sought by the parties, i.e. the reduction in ordinary from 39 to 38 will be operative from the first full pay period to commence on or after 1 June, 1993, and the third minimum rates adjustment will be operative from the first full pay period to commence on or after 30 July, 1993. The Orders arising out of these two applications are attached.
