REASONS FOR DECISION

This is an application by The Tasmanian Registered Teachers' Association (TRTA) to vary the Independent Schools (Teachers) Tasmania Award by increasing certain wage rates and allowances applicable to Band 1 and Band 2 teachers.

The present matter is one of consent and represents the final step in a phasing arrangement to give effect to understandings reached between the parties relating to the final figure set for a teacher at the top level of Band 1 and contained in both existing award provisions and recorded in earlier transcripts.

The achievement of this objective was made possible through the Commission granting "special case" status to the TRTA's original application (T.2819 of 1990) to progress its claim for eventual parity of wage rates for teachers employed in private schools.

At a hearing in Hobart on 14 July 1993 the parties were able to draw some comfort from the Full Bench's decision1 of 30 November 1993, in the public sector teachers pay case, as well as earlier decisions of mine accepting that there had been illustrated a significant net addition to work value requirements.

It follows therefore that the present matter is acceptable as having met the requirements of current Wage Fixing Principles.

The effect of the variation will be to increase the rate of annual salary of a Band 1 teacher at step 12 from $38,130 to $38,950. Proportionate increases will apply to all Band 2 teachers as well as to work-related allowances.

Because the present adjustments are confined to a limited number of classifications and were part of an understanding which was reached earlier schools have been in a position to budget for the increases now sought. Accordingly I am satisfied that to grant the present application would be consistent with public interest requirements of the Act.

In all of these circumstances the application is granted and the award will be varied.

OPERATIVE DATE:

This variation shall come into operation from the first full pay period to commence on or after 1 August 1993.
