Award variation - insertion of MTAA Superannuation Fund into Clause 21 - Occupational Superannuation subclause (d)

REASONS FOR DECISION

In this matter the Tasmanian Chamber of Commerce and Industry Limited (TCCI) sought the variation of the Automotive Industries Award to include in Clause 21 - Occupational Superannuation, subclause (d), reference to MTAA Industry Superannuation Fund (for employees of Mike Trinders Autoland Pty Ltd) (Trinders) only.

The circumstances behind this application were that Trinders were of the opinion that it was subject to the Federal Vehicle Industry Repair Services and Retail Award. That award specifies, among others, the MTAA Industry Superannuation Fund (MTAA) used by Trinders for occupational superannuation purposes.

In order to remedy this inadvertence by Trinders Mr Edwards appearing for the TCCI requested MTAA to be included in the award. He satisfied the Commission as required by Section 32 of the Act that MTAA is a complying fund and that it met the wishes of employees.

The variation was supported by Mr Noonan appearing for the Shop, Distributive and Allied Employees Association, Tasmanian Branch.

Having regard to the foregoing the award will be varied in the manner requested operative from the first full pay period to commence on or after 1 January 1991.

The order is attached.
