FURNISHING TRADES AWARD

Award variation - Clause 6 - Parties and Persons Bound - name change due to amalgamation of FFTS and CFMEU - consent matter - award varied - operative 16 August 1993

REASONS FOR DECISION

This application was lodged by the Construction, Forestry, Mining and Energy Union, Tasmanian Branch (CFMEU) for the purpose of varying Clause 6 - Parties and Persons Bound of the Furnishing Trades Award. Specifically, they sought to delete the name of the Furnishing Trades Society of Australasia, Tasmanian Branch (FFTS) and insert in lieu thereof the name of the Construction, Forestry, Mining and Energy Union, Tasmanian Branch.

Mr Clifford for the CFMEU tendered an exhibit (C3) being a decision of the Registrar of the Commission (TR. 453 of 1993) which, amongst other things, cancelled the registration of the FFTS and stated -

"...a certificate of registration in the name of the Construction, Forestry, Mining and Energy Union, Tasmanian Branch, will be issued in accordance with Section 64 bearing the names of the awards in which the deregistered organisations formerly held an interest."

I am satisfied that the Furnishing Trades Award should be varied in the manner sought by the applicant and I decide accordingly.

In view of that decision the Commission will take the necessary steps to delete all reference in the award to the Federated Furnishing Trades Society of Australasia, Tasmanian Branch.

The Order giving effect to this decision will follow in due course and will be operative from 16 August, 1993, being the date of application.
