Award variation - superannuation exemptions

REASONS FOR DECISION

This application by the Tasmanian Chamber of Commerce and Industry Limited (TCCI) was to exempt Richardson and Wrench, Rosny Park (RWRP) from making occupational superannuation contributions to either of the nominated funds in the Estate Agents Award in favour of the GIO Personal Superannuation Fund (GIO).

Mr Clues appearing for the TCCI informed the Commission that GIO was a complying fund and that it met the wishes of employees. Supporting documentation was submitted as Exhibit TCCI.1 and 2. Having regard to the foregoing the Commission was satisfied that the requirements of Section 32(1B)(a) and (b) of the Act had been met.

The application for the exemption of RWRP was also supported by Mr Clegg for the Australian Municipal, Administrative, Clerical and Services Union.

In all of the circumstances the exemption for RWRP is granted operative from the first full pay period to commence on or after 17 November 1993. The order is attached.
