Wage rates - State Wage Case December 1993 - arbitrated safety net adjustment

REASONS FOR DECISION

This was an application made by the Australian Liquor, Hospitality and Miscellaneous Workers Union - Tasmanian Branch (the Union) for the $8 arbitrated safety net adjustment, determined by a full bench of the Commission in the State Wage decision dated 24 December 19931 to be implemented in the Aerated Waters Award (the Award).

At the hearing the Union, in seeking the increase, confirmed that there had been some restructuring of the Award under the Structural Efficiency Principle, but there was still some further way to go: the Minimum Rates Adjustment process was yet to be settled. The Union also indicated that it was prepared to take part in enterprise bargaining negotiations, but to date, employers had not shown any interest in that area.

The Tasmanian Chamber of Commerce and Industry Limited (the Chamber) advised that it was not against the application, but submitted that, as no draft order had been produced by the Union, the operative date should be set at the date it was produced eventually. The Chamber reiterated its position as to the prescriptions for junior employees saying that the same column format as the Commission had applied to adults should consistently be applied to juniors.

The Chamber considered that the granting of the application would not be against the public interest.

The Award will be amended as sought operative from the date of this decision.

It should be noted that the Commission has accepted the Chamber's submissions as to the absorption of the proportional increase for juniors against any overaward payments, but has declined to implement a column format.

An order will be issued in due course.
