CONCRETE PRODUCTS AWARD

COMMISSION P A IMLACH

18 February 1994

Wage Rates - State Wage Case December 1993 - arbitrated safety net adjustment

REASONS FOR DECISION

These two matters were joined for hearing: they were applications by The AWU-FIME Amalgamated Union, Tasmania Branch (the AWU-FIME) and the Australian Municipal, Administrative, Clerical and Services Union (the AMACSU) for the $8 arbitrated safety net adjustment, determined by a full bench of the Commission in the State Wage decision dated 24 December 1993 (T4692 of 1993) to be implemented in the Concrete Products Award (the Award).

The AWU-FIME, in seeking the increase, submitted that the application was in accordance with all the requirements of the December 1993 State Wage Case decision and the Act. A draft order was produced.

The AWU-FIME reported that the Award had not yet been restructured, but negotiations to that end were well advanced. There had also been more discussions between the parties on enterprise agreements, but, with no results to date.

The AMACSU supported the AWU-FIME submissions.

The Tasmanian Chamber of Commerce and Industry Limited consented to the applications.

I am satisfied that the applications meet all the requirements of the Act and the Principles of the Commission and the Award will be amended as sought operative from the date of this decision.

The Order giving effect to this decision will follow in due course.
