REASONS FOR DECISION

At a resumed hearing on 11 July 1994 the Tasmanian Chamber of Commerce and Industry Limited (TCCI) was granted leave to amend its application to incorporate a number of variations to the Welfare and Voluntary Agencies Award which could best be categorised as a redrafting and simplification of conditions of employment matters. It had been long recognised by all parties to the award that radical improvement was required to remove redundant provisions, eliminate unnecessary duplication, add some new definitions, reword existing provisions to make them gender neutral, and generally make the award more user friendly and consistent with legislative changes.

The formal process of seeking to vary the award by consent constituted the final steps in a long exercise and followed a series of informal conferences and discussions extending over many months.

The parameters of the exercise now completed were confined to the radical tidying up of award clauses but did not involve considerations of merit. Thus the outcomes were cost neutral.

The most significant changes proposed were to:

(1) Title
(2) Scope
(3) Parties and Persons Bound
(4) Definitions
(5) Right of Entry
(6) Occupational Superannuation

The end product produced by the working party is to be commended and those who were involved are to be congratulated on a job well done.

I accept the terms of the draft award as proposed with one exception; that being the proposed deletion of the Australian Nurses Federation from the "Parties and Persons Bound" clause. This essentially is a registration matter because the award clause simply mirrors that which is contained on that organisation's certificate of registration in relation to award interest.

It is therefore my decision that the balance of award changes put forward are endorsed as being consistent with the Commission's Wage Fixing Principles and public interest.

Date of Operation

These variations to the award (which is to concurrently be consolidated) shall come into operation from the first full pay period to commence on or after 11 July 1995.
