WHOLESALE PLANT BAKERIES AWARD [Correction Order]

COMMISSIONER R J WATLING

HOBART, 2 October 1995

Award variation - rates of pay and conditions of employment - consent matter - operative ffpp 9 October 1995

REASONS FOR FURTHER DECISION

On 31 March 1995 the Commission handed down an order, arising out of this application, which established the Wholesale Plant Bakeries Award.

In the decision which gave rise to the order it was noted that the parties sought the making of the new award because -

"1. that the current Bakers Award was too diverse and as a result it was extremely difficult to progress award restructuring and modernisation;

2. the proposed new award would cater for the specific needs of the major plant bakeries; and

3. it would accelerate restructuring and the implementation of classification standards and relativities along with minimum rates adjustments."

Also in that decision the Commission indicated that until the making of the Wholesale Plant Bakeries Award had been finalised in respect of rates of pay and conditions of employment the Bakers award would continue to apply.

At a further hearing of this matter on 27 September 1995 the parties informed the Commission that their discussions, in respect of finalising the making of the new award, had been successfully concluded and they presented a consent draft order to the Commission which dealt with the following subject matters:

Definitions
Wage Rates,
Annual Leave
Casual and Part-Time Employees (as defined)
Clothing
Compassionate Leave
Contract of Employment
Disputes Procedure
First Aid Allowance
Full Week's Wages to be Paid
Higher Duties
Holidays With Pay
Hours of Work
Notice Board
Overtime
Parental Leave
Payment of Wages
Right of Entry of Union Officials
Sick Leave
Structural Efficiency
Superannuation
Time and Wages Book
Union Delegate

The wage rates contained in the consent draft order reflect the first of two minimum rates adjustments which will be operative from the beginning of the first full pay period to commence on or after 9 October 1995.

It was foreshadowed that the second minimum rates adjustment would be operative from the beginning of the first full pay period to commence on or after 1 October 1996.

Having had the benefit of hearing the submissions of the parties, during both this and earlier hearings, and having considered the contents of the consent draft order, I hereby determine that the award should be finalised in the manner sought by the parties as it is consistent with the Wage Fixing Principles and the Public Interest requirements of the Act.

An Order giving effect to this decision is attached.
