Making of new award - title and scope - consent matter

REASONS FOR DECISION

This application, lodged by The Australasian Meat Industry Employees Union, Tasmanian Branch, pursuant to section 23 of the Act, was for the purpose of establishing a new award to be known as the Meat Industry Award.

It was stated by the parties that this consent application formed part of the restructuring programme for the Abattoirs Award, Meat Trades Award and the Poultry and Game Products Processing Award.

The parties requested the Commission to make a single award to replace the three previously mentioned awards which would cover -

"(a) Export Abattoirs, licensed as such under the Export Control Act 1982;
(b) Meat premises, licensed as such under the Meat Hygiene Act 1985;
(c) Smallgoods manufacturing;
(d) Processing meat, meat products, game meat, poultry and pet food;
(e) Wholesaling of meat, meat products, game meat, poultry and pet food'
(f) Retailing of meat, meat products, game meats, poultry and pet food (where it is prepared and packed for sale on the premises)."

It was the submission of the parties that until the making of the award had been finalised in respect to rates of pay and conditions of employment then the existing awards would apply.

The parties foreshadowed that applications would be made in due course to rescind the previously mentioned awards on the same date as the wage rates and conditions of employment determined for the new Meat Industry Award.

I recognise that the application is part of the restructuring programme for the three awards of the Commission and I am satisfied that it will provide an avenue to create appropriate classification standards and career paths for employees within the industry.

The application is endorsed by the Commission in the terms outlined in exhibit S1 and will be operative on and from 3 March 1995. The Order giving effect to this decision is attached.

Having decided to establish this new award it is now open to any registered organisation to seek an interest in the award in accordance with the provisions of the Industrial Relations Act 1984. After determining the organisations that have an interest in the award, the Commission will continue to hear submissions associated with the rates of pay and conditions of employment to be contained in that award.
