Award variation - insertion of Career Start Traineeship provision

REASONS FOR DECISION

This was an application by the Australian Liquor, Hospitality and Miscellaneous Workers Union, Tasmanian Branch (the Union) for amendments to be made to the Licensed Clubs Award (the Award). The amendments sought related to the insertion of provisions for employees undertaking Career Start Traineeships.

The proposed amendments included a definition worded as follows:

" `Career Start Traineeship' means a system of training with an employee covered by Clause 2 - SCOPE, of this award, PROVIDED THAT such system of training shall apply only to persons engaged in the occupation of Greenkeeper. The Career Start Traineeship shall comprise structured off-the-job training (as defined) in a Technical and Further Education College or other training provider(s) approved by the Tasmanian State Training Authority, or other Statutory Authority as part of a training agreement (as defined)."

The Union outlined the details of the proposed amendments to the Award and sought approval for the application.

The Tasmanian Chamber of Commerce and Industry Limited (the Chamber) in supporting the proposed amendments also confirmed that they were the same as those inserted in other awards of the Commission for Career Start Traineeships. The Chamber consented to the application.

The parties also confirmed that the provisions sought were only to apply to greenkeepers as specified in the Career Start Traineeship definition.

I accept the submissions of the parties and I am satisfied that the approval of the application will not breach the public interest requirements nor the Wage Fixing Principles.

I approve the amendments sought and they will operate from the first full pay period commencing on or after 18 January 1995.
