REASONS FOR DECISION

This was an application made under Section 23 of the Industrial Relations Act 1984 by the Tasmanian Chamber of Commerce and Industry Limited (the Chamber) for a variation to be made to the Furnishing Trades Award (the Award).

The Chamber submitted a detailed draft order with the application.

The application sought to insert in the Award, appropriate standard provisions for the Career Start Trainee System (CST) which, as outlined in submissions from the Chamber, was really an expansion of the Australian Traineeship Scheme (already provided for in the Award) which latter related only to young persons whereas the former CST, applied to unemployed persons generally and was more flexible in its operation. The Chamber also adverted to some small consequential changes to the Award necessary as a result of the proposed variations.

The Commission was advised that discussions between the parties concerning the details of the application had commenced in March 1995 and agreement had been reached.

The Chamber also submitted that the application was not against the Guidelines of the Commission, nor was it against the public interest.

The Chamber requested that the date of operation be the first full pay period commencing on or after the date of the hearing.

The Construction, Forestry, Mining and Energy Union endorsed the submissions of the Chamber including those as to operative date and confirmed its agreement to the variations applied for.

I accept the submissions of the parties: the Award will be amended as requested from the dated agreed. An order is attached.
