HERD IMPROVEMENT BOARD OF TASMANIA STAFF AWARD

Award - rescind - operative 22 August 95

REASONS FOR DECISION

This application, made by the Minister for Public Sector Management, sought to rescind the Herd Improvement Board of Tasmania Staff Award pursuant to section 32(7A) of the Act.

Section 32(7A) states -

"The Commission may, of its own motion or upon application by an organization and after consultation with such organizations as it considers appropriate, by notice in the Gazette, rescind an award it considers no longer serves any useful purpose."

The scope of the award reads as follows -

"2. SCOPE

Subject to the exceptions and conditions contained herein, this award shall apply to all persons permanently or temporarily employed by the Herd Improvement Board of Tasmania under the provisions of the Tasmanian State Service Act 1984 and who occupy a position covered by this award."

Mr Willingham, for the Minister for Public Sector Management, stated that the Herd Improvement Amendment Act 1988 dissolved the Herd Improvement Board and employees of the Board were transferred to the Dairy Industry Authority and as a result were covered by other awards of the Commission.

This award has not been adjusted since that time and given that it could be said to be obsolete, its continuation will serve no useful purpose.

At the request of the applicant I hereby determine that the Herd Improvement Board of Tasmania Staff Award be rescinded as an award of the Tasmanian Industrial Commission on 22 August 1995 and I so Order.
