TASMANIAN INDUSTRIAL COMMISSION Industrial Relations Act 1984 Health Services Union of Australia, DISABILITY SERVICE PROVIDERS AWARD
Award interest - withdrawal - application granted REASONS FOR DECISION In this matter the Health Services Union of Australia, Tasmania No. 1 Branch (HSUA) requested that the interest of the Australian Nursing Federation Tasmanian Branch in the Disability Service Providers Award (previously the Welfare and Voluntary Agencies Award) be deleted from their certificate of registration pursuant to Section 65A of the Industrial Relations Act 1984. The HSUA indicated at a preliminary hearing on 11 September 1995 that its application was based upon a belief that the ANF had no members employed in the industries now described in the revised scope clause of this award. Mr Law for the ANF sought and was granted an adjournment to enable some research to be carried out; to obtain further instructions; and for the parties to consult. When the hearing was resumed on 9 October the parties signified their agreement to the terms of the HSUA request. As a consequence it is my decision to determine that, pursuant to Sections 65A and 63(10)(c) of the Act, that the Australian Nursing Federation Tasmanian Branch no longer has an interest in the Disability Service Providers Award which was previously titled the Welfare and Voluntary Agencies Award. A copy of this determination shall be provided to the Registrar in accordance with the requirements of Section 65A(6) of the Act.
