REASONS FOR DECISION

These six applications which were joined for hearing purposes were for the second Minimum Rates Adjustment (MRA) and the second arbitrated Safety Net Adjustment (SNA) to be implemented together in the Licensed Clubs Award, the Restaurant Keepers Award and the Hotels, Resorts, Hospitality and Motels Award (the three awards).

Because of Federal counterpart award precedents the implementation of the second MRA in Division B of the Hotels, Resorts, Hospitality and Motels Award was excluded from the relevant application (T.5867 of 1995).

The MRA process commenced in the three awards on 1 May 19951.

The applicant, the Australian Liquor, Hospitality and Miscellaneous Workers Union (Tasmanian Branch) (the Union), advised the Commission that negotiations had taken place with the Tasmanian Chamber of Commerce and Industry Limited (the Chamber) and complete agreement had been reached on the applications, the draft orders and the date of commencement, the first full pay period on or after 1 November 1995.

The Union submitted that the applications were in accordance with the Guidelines of the Commission and were not against the public interest.

The Chamber confirmed its consent to the applications and that the amounts claimed in the MRA's were consistent with the schedules produced at the commencement of that process in May of 1995.

The Chamber also confirmed its agreement to the commencement date sought.

The representatives of the Registered Clubs of Tasmania Co-operative Society Limited, also confirmed their agreement to the proposals and the commencement date.

I am satisfied that the applications are within the Guidelines and not against the public interest.

The three awards will be amended as requested to commence from the first full pay period on or after 1 November 1995.

Orders for the Hotels, Resorts, Hospitality and Motels Award and the Licensed Clubs Award are attached. A consolidated Restaurant Keepers Award will be issued in the near future.
