TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984
s.23 application for award or variation of award

Minister for Industrial Relations and Training
(T.5948 of 1995)

TOTALIZATOR AGENCY AWARD

DEPUTY PRESIDENT A ROBINSON

HOBART, 5 December 1995

Award variation - deletion of superfluous provisions and amend wording

REASONS FOR DECISION

This matter concerns an application by the Minister for Industrial Relations and Training to vary the Totalizator Agency Award.

The application sought to delete what was considered superfluous provisions and to amend the wording of the award consistent with the continuous process of reviewing awards of the Commission for relevance.

More particularly the application sought to deal with the following provisions:

· Scope
· Date of Effect
· Supersession and Savings
· Award Interest and Parties Bound
· Preference of Employment
· Right of Entry of Union Officials
· Existing Wage Rates
· Occupational Superannuation

The matter was one of consent and was consistent with the decision of a Full Bench[1] of this Commission dated 27 October 1995. I find also that the award changes are consistent with both the Commission's Wage Fixing Principles[2] and public interest.

For these reasons the application is granted and the award will be varied in the manner sought with effect on and from 5 December 1995.

Order to follow.

A Robinson
