TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984
s.32(7) application for rescission of award

Minister for Public Sector Administration
(T6457 of 1996)

TECHNICAL AND FURTHER EDUCATION STAFF AWARD

COMMISSIONER R J WATLING

HOBART, 27 September 1996

Award - rescind - operative 27 September 1996

REASONS FOR DECISION

This application, lodged by the Minister for Public Sector Administration (the applicant), sought to rescind the Technical and Further Education Staff Award.

Ms A Watt, for the applicant, presented a submission to the Commission which, simply stated, identified that employees who fell within the scope of the Technical and Further Education Staff Award are now covered by the an award of the Australian Industrial Relations Commission and, as a result, the award in now superfluous.

Section 32(7A) of the Act states -

"The Commission may, of its own motion or upon application by an organization and after consultation with such organizations as it considers appropriate, by notice in the Gazette, rescind an award it considers no longer serves any useful purpose."

At the request of the applicant and all the parties to the award, I hereby determine that the Technical and Further Education Staff Award be rescinded as an award of the Tasmanian Industrial Commission on and from 27 September 1996, and I so Order.
