REASONS FOR DECISION

This was an application under Section 23(1) of the Act by the Minister for Public Administration (the Minister) for a variation to be made to the Inland Fisheries Commission Staff Award (the Award).

The principal changes sought by the Minister were:

  • A new title for the Award - the "Inland Fisheries Commission Award".
  • The implementation by way of annexure of the tables facilitating translation to the Administrative and Clerical Employees Award, the Scientific Employees Award and the Technical Employees Award for employees covered by the Award. This included some additional conditions of employment provisions relating to Higher Duties Allowance and Overtime.
  • A general review of the wording and superfluous provisions in the Award similar to that already carried out in some other State Service Awards.

The Minister submitted that the variations and deletions proposed were all consistent with the Principles of the Commission, especially the structural efficiency Principle, and that approval was not against the public interest.

Consistent with the established operative date for all State Service Awards being translated to the "streams" awards, the Minister requested that the amendments arising out of this application be made to commence on and from 7 March 1996.

The Community and Public Sector Union (State Public Services Federation Tasmania) supported the submissions of the Minister and sought approval for the application.

I am satisfied that this application has been made in accordance with the Guidelines of the Commission and its approval is not against the public interest.

The Award will be amended to operate on and from 7 March 1996.
