REASONS FOR DECISION
The applicant in these proceedings is the Australian Liquor, Hospitality and Miscellaneous Workers Union - Tasmanian Branch (ALHMWU). The union, which is the only employee organisation with a relevant award interest, seeks to vary the Veterinary Services Award to reflect the first $8 Safety Net Adjustment authorised by the State Wage Case decision of 24 July 1996. The application, which I amended in a minor way by consent, does not concern itself with allowances.
The application proceeded by way of consent, ALHMWU submitting and the Tasmanian Chamber of Commerce and Industry Limited (TCCI) agreeing that there are no offsets arising from previous wage increases reached at an enterprise level since 1 November 1991, and that the application complies with the public interest requirements of Section 36 of the Act.
ALHMWU committed itself to continued implementation of the award restructuring programme, particularly in relation to negotiating a new award and settling claims regarding minimum rates adjustment.
In my view, the parties’ submissions and expressions of agreement satisfy the requirements of the Wage Fixing Principles regarding the First Safety Net Adjustment and do not raise public interest issues under Section 36 of the Act. Accordingly, I will vary the award in the manner set out in the amended application, with effect from the first full pay period to commence on or after 28 October 1996. My Order, in that form, accompanies this decision.
