REASONS FOR DECISION

These amended applications, lodged by the Australian Municipal, Administrative, Clerical and Services Union and the Shop, Distributive and Allied Employees Association, Tasmanian Branch (the applicants), were for the purpose of varying the Retail Trades Award to insert a new clause to provide for carer's leave, thus giving effect to a Full Bench decision arising out of applications T6296 of 1996 and T6441 of 1996.

Mr Paterson, on behalf of the applicants produced an agreed draft Order, which varied from the draft model clause arising out of the previously mentioned Full Bench decision, to the extent that it was made consistent with the Retail Trades Award and provided carer's leave for part-time employees.

Mr Gates, of the Tasmanian Chamber of Commerce and Industry Limited, advised the Commission that following discussions with the applicants, the organisation he represented consented to the variations in the form outlined in the amended draft Order. He said the applications were consistent with the Wage Fixing Principles, the public interest and the decision arising out of the Full Bench dealing with the subject matter of these applications.

I accept the submissions of the parties and grant the applications as they are consistent with previous decisions of the Commission, especially those arising out of applications T6296 of 1996 and T6441 of 1996.

The Order giving effect to this decision is attached and will be operative from the first full pay period to commence on or after 18 April 1997.
